This website is operated by Delicate Rebel Pty Ltd trading as Delicate Rebel ("Delicate Rebel", "we", "us" and "our"). These Terms of Service apply to your use of our website, products and services, including purchases made through www.delicaterebel.com.au.
By accessing our website or placing an order, you agree to these Terms of Service, our Privacy Policy, Shipping Policy and Return and Refund Policy.
Online store terms
You must not use our website or products for any unlawful purpose. You must not interfere with the security, operation or functionality of the website, attempt unauthorised access, submit false information, or use our content, products or services in a way that may cause harm to us, our customers or third parties.
Product information and availability
We make every effort to display product information, images, prices, colours, sizes, availability and descriptions as accurately as possible. However, we do not guarantee that all website content is free from errors, omissions or inaccuracies.
We may update, change or discontinue products, colours, options, prices, promotions or availability at any time without notice, except where this would affect an order already accepted by us in a way not permitted by law.
Made-to-order boots
Unless clearly marked as in stock or ready to ship, all Delicate Rebel boots are made to order. Each pair is individually created after your order is placed and payment has been received.
Production typically takes approximately 6-8 weeks, unless a different timeframe is shown on the product page or confirmed by us in writing. This timeframe is an estimate only and may vary due to product style, custom design details, supplier workload, material availability, quality control, seasonal demand, customer approval delays and other circumstances outside our control.
By placing an order for made-to-order boots, you acknowledge and accept that production time is required before dispatch and that delivery time begins only after dispatch.
Ready-to-ship stock
Selected products may be available as in-stock or ready-to-ship items. These will be clearly marked where applicable. Ready-to-ship items are generally dispatched within 2-3 business days after payment authorisation, excluding weekends and public holidays, unless otherwise stated.
Custom orders, design approval and customer-supplied details
For custom boot orders or personalised products, you may be asked to provide design details, inspiration images, artwork references, colour preferences, sizing information, measurements, event dates, written approvals or other information needed to produce your order.
You are responsible for ensuring that all details, sizes, measurements, spelling, colours, design notes, images and approvals you provide are complete and accurate.
Once you approve a design, measurement, order detail or production instruction, we may proceed based on that approval. Changes requested after approval or after production has started may not be possible and may incur additional costs if they can be made.
If you supply images, artwork, designs, logos, names, text or other materials, you confirm that you have the right to provide and use those materials and that our use of them to fulfil your order will not infringe another person's rights.
Colour, screen and photography differences
Product colours may appear different in real life compared with images shown on our website, social media, advertising, design references, mock-ups or digital proofs. This may be caused by lighting, photography, editing, screen settings, device displays, contrast, brightness, filters or environmental conditions.
We cannot guarantee that your device display will accurately show the true colour, tone, texture or finish of the final product.
Genuine leather and material variation
Our Premium boots are made using genuine leather and individual materials. Leather is a natural material and is not perfectly uniform. Natural variations may include differences in grain, texture, tone, markings, scars, creases, softness, colour, finish and how the material responds during production and wear.
Because our products are custom made and hand-finished, slight differences may occur in stitching, embroidery, pattern placement, leather panels, lining, heel finish, sole finish and overall appearance.
These natural and custom-made characteristics are part of the product and are not considered faults unless the product fails to meet consumer guarantees under Australian Consumer Law.
Sizing, measurements and fit
Customers are responsible for selecting the correct shoe size, calf height, calf width and any other size or measurement options before completing checkout.
Any sizing guide, measurement guide, recommendation or customer support advice provided by us is general guidance only. Final size selection and measurement confirmation remains the responsibility of the customer.
If you are unsure about sizing, fit, calf height, calf width or measurements, please contact us before ordering. Once production has started, changes may not be possible.
Special events and required dates
If you require an order for a wedding, photoshoot, competition, holiday, performance, event or specific date, you must contact us before placing your order. We cannot guarantee a delivery date unless we have confirmed this with you in writing.
We are not responsible for event cancellation, event changes, customer delay in ordering, customer delay in providing approvals, or delivery delays outside our control where we have not expressly guaranteed the date in writing.
Changes and cancellations
Made-to-order and custom orders cannot usually be cancelled, changed, returned or exchanged once production has started, except where required under Australian Consumer Law.
If you request a cancellation or change before production begins, we will consider the request at our discretion. Any approved change may be subject to additional cost, price difference, administration time, material costs or supplier costs already incurred.
Order refusal or cancellation by us
We reserve the right to refuse, cancel or limit an order where we reasonably believe there has been a pricing or product listing error, suspected fraud, misuse of a discount, inappropriate or offensive custom request, breach of these terms, unavailability of materials, inability to fulfil the order, or another valid reason.
If we cancel an order before production begins and you have already paid, we will provide a refund of the amount paid for the cancelled item unless another arrangement is agreed or permitted by law.
Pricing, payment and discounts
All prices are shown in Australian dollars unless otherwise stated. Prices may include or exclude GST depending on how they are displayed at checkout and our tax obligations at the time of purchase.
Payment must be authorised and received before an order is accepted or production begins. We may use third-party payment providers to process payments securely.
Discount codes, promotions and offers are subject to their stated terms. Unless expressly stated, discounts cannot be combined, applied retrospectively, exchanged for cash, or used after expiry.
Shipping and delivery
Shipping is governed by our Shipping Policy. Delivery timeframes are estimates only unless we have confirmed a specific date in writing. We are not responsible for courier, postal, customs or delivery delays outside our reasonable control.
Customers are responsible for providing accurate shipping details. Additional postage or handling costs may apply if an order is returned, redirected or re-sent because incorrect details were provided or delivery was not accepted or collected.
Returns, refunds and consumer guarantees
Returns and refunds are governed by our Return and Refund Policy. Nothing in these Terms of Service excludes, restricts or modifies any rights you may have under Australian Consumer Law.
We do not provide refunds, returns or exchanges for made-to-order or custom products due to change of mind, incorrect size selection, incorrect measurements, colour expectations caused by screen differences, natural leather or material variation, event cancellation, preference changes or customer error, except where required by Australian Consumer Law.
Warranty, care and normal wear
Delicate Rebel stands behind the quality of its products. If you believe your product has a manufacturing or material fault, please contact us with your order details and photos so we can assess the issue.
Our warranty and consumer guarantee assessment does not cover normal wear and tear, misuse, neglect, incorrect care, water damage, heat damage, accidental damage, damage caused by chemicals, odour, stains, improper storage, modification, unauthorised repair, or use outside the product's intended purpose.
Natural leather will change over time with wear, movement, moisture, heat, sunlight, storage and care. This ageing process is normal and is not automatically considered a fault.
Website content and intellectual property
All website content, images, photography, graphics, logos, product designs, text, branding, trade marks, packaging concepts and other materials displayed by Delicate Rebel are owned by or licensed to us, unless otherwise stated.
You must not copy, reproduce, modify, distribute, use, sell or exploit our content, branding, product images or designs without our prior written permission.
Reviews, tags and social media content
If you tag Delicate Rebel, mention us, send us photos, videos, reviews, testimonials or other content, you give us permission to share, repost or use that content for marketing, social media, website, email or promotional purposes, unless you tell us in writing that you do not consent.
We may edit user content for length, format or clarity, but we will not intentionally misrepresent your experience. You must only provide content that you have the right to share.
Third-party links, platforms and tools
Our website may include links to third-party websites, services, social media platforms, payment processors, shipping providers, Shopify tools or other external services. We are not responsible for third-party websites, policies, actions, content, availability, security or accuracy.
Privacy
Our collection, use and disclosure of personal information is governed by our Privacy Policy. By using our website or placing an order, you acknowledge that you have read our Privacy Policy.
Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, loss of profits, loss of opportunity, loss of data, event costs, photoshoot costs, travel costs or other losses arising from your use of our website, products or services.
Nothing in these terms limits any liability that cannot be limited under Australian Consumer Law or other applicable law.
Governing law
These Terms of Service are governed by the laws of Australia and the laws of [insert state/territory]. You agree to submit to the non-exclusive jurisdiction of the courts of that state or territory.
